Kulke's attorney Sean McKinney told E! Online that Tennessee prosecutors decided not to pursue the case because it would be a waste of taxpayers' dollars.

McKinney also disclosed that charges were not pressed because Kulke thought he was allowed to enter the property, after allegedly being granted permission by the guards.

Swift's property also reportedly lacks 'No Trespassing' signs.

The 'One Thing' pop star, who was recently named the most charitable celebrity of 2012, was not home at the time of the alleged trespass.

Declaring himself a fan of Swift's at the time of his arrest, Kulke will appear in court on January 29, 2013 for a different matter.

He is c! urrently fighting extradition back to Colorado, where he faces probation violations including a burglary charge.
